Two separate rules. One applies to everyone.
For over two decades, businesses turning over less than $3 million haven't had to comply with the Privacy Act at all. That exemption is being removed on 10 December 2026 — about 2.5 million Australian businesses will be covered by privacy law for the first time.
A second, separate rule lands the same day, and this one isn't about turnover — it applies to every business, regardless of size, that was already covered by the Act or is about to be. If you use AI or an automated system to make, or substantially help make, a decision about a person, you'll need to disclose that in your privacy policy. Neither rule has a confirmed grace period, and the regulator is already active.
Who this hits first: the OAIC's January 2026 compliance sweep already targeted real estate agents, chemists, licensed venues and car dealers — sectors much like the trades, allied health and professional services businesses momentuum works with.
